1. Your Privacy 閣下的私隱權利

HART Collective Limited (“HART”) ( “we” or “us”) respect your legal rights of privacy when collecting, storing, using and transmitting your personal data and this Privacy Policy Statement (the “Statement” ) explains our privacy practices. It is our policy to comply with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486) (the “Ordinance” ) of the Laws of the Hong Kong Special Administrative Region of the People’s Republic of China ( “Hong Kong” ). Personal data will be collected only for lawful and relevant purposes and all practicable steps will be taken to ensure that personal data held by us is accurate. We shall take all practicable steps to ensure security of the personal data and to avoid unauthorized or accidental access, erasure or other use.

Please read the following carefully to understand our policy and practices regarding how your personal data will be treated. This Statement applies to the collection of your personal data through website(s), mobile applications and other data collection means (“Data Collection Means”) designed, used and managed by “HART Collective Limited”, and may from time to time be revised or otherwise changed where we deem necessary.
If there is any inconsistency between the English and Chinese version of this Statement, the English version shall prevail.

Throughout this Statement, the meaning of the term “personal data” is as defined in the Ordinance.

HART Collective Limited (「HART」) (「我們」)在收集、保存、使用及傳送個人資料時，尊重法律賦予閣下的私隱權利；而本「私隱政策聲明」 (「本聲明」) 旨在說明我們處理個人私隱的做法。我們的政策是要遵守中華人民共和國香港特別行政區(「香港」)法例第486章《個人資料(私隱) 條例》 (「條例」) 的規定。我們收集個人資料只用作合法及相關目的，我們亦會採取可行的步驟以確保所保存的個人資料是準確。我們會採取可行的步驟以確保個人資料的安全及防止未經授權或意外的存取、刪除或其他用途。

以下將詳細說明我們處理閣下之個人資料的政策及做法，請仔細參閱及理解。本聲明適用於由 HART Collective Limited 設計、採用及管理的網站、手機應用程式及其他收集資料的渠道(「收集資料的渠道」)所收集的閣下之個人資料。我們有權按需要隨時修訂或另行更改本聲明。

倘若本聲明的英文本與中文本有任何抵觸，一概以英文本為準。

在本聲明中，「個人資料」一詞採用條例對該詞的定義。

2. Personal Data Collection and Use 個人資料的收集及使用

We may collect your personal data including but not limited to your name, telephone number, email address and residential area (“Personal Data”) that are reasonably necessary to provide you with information of our events, promotions, products and/or services. You are not obliged to supply the data, but if you do not, we may not be able to provide you with our products or services.

The purposes for which we may use your personal data are as follows:

• offering, providing and marketing to you our products/services offered at HART Haus and other collaborating sites, and administering, maintaining, managing and operating such products/services (see also “Use and provision of personal data in direct marketing” at paragraph 4 below);

• collecting data for identity verification and record and maintaining contact lists for correspondence at HART Haus and other collaborating sites;

• processing and evaluating any applications or requests made by you for products/services offered by HART Haus and other collaborating sites;

• designing, providing and marketing to users HART Haus and other collaborating sites’ facilities, services and/or products;

• promoting, improving and/or furthering the provision of HART Haus and other collaborating sites, services and/or products;

• conducting market research for statistical purposes at HART Haus and other collaborating sites;
  delivering information that you may have interest in, such as targeted banners, new services and products and other promotions and marketing materials at HART Haus and other collaborating sites;

• matching any data held which relates to you from time to time for any of the purposes listed herein;
  complying with any law binding on us or for the purposes of any guidelines or codes of practice issued by regulatory or other authorities with which we are reasonably expected to comply; and

• any other purpose(s) which has been agreed by or notified to you.

If you are under the age of 18, you must ask your parent or guardian before providing any personal data to us.

為向閣下提供我們的活動、推廣、產品及/或服務，我們將收集合理所需的閣下的個人資料，包括但不限於閣下的姓名、電話號碼、電郵地址及居住地區 (「個人資料」)。閣下並非必須提供資料，但如閣下沒有提供資料，我們可能因此而不能向閣下提供有關產品及服務。

我們可能會將閣下的個人資料作以下用途：

• 向你提供及行銷我們於 HART Haus 及其合作據點提供的產品/服務，及管理、維持、處理及經營這些產品/服務 (見第4段「使用或提供個人資料以作直接促銷」);

• 為於 HART Haus 及其合作據點核實及記錄身份而收集資料，並維持通訊錄作聯繫；

• 處理及評估任何閣下就於 HART Haus 及其合作據點提供的產品/服務的申請或要求;

• 為使用者設計及向使用者提供及推廣於 HART Haus 及其合作據點的設施、服務及/或產品；

• 就於 HART Haus 及其合作據點提供的設施、服務及/或產品作出推廣、改進及/或推展；

• 於 HART Haus 及其合作據點進行市場調查作統計用途;

• 向使用者提供使用者有興趣之資訊，例如 HART Haus 及其合作據點有針對性之橫幅、新服務及產品及其他宣傳及市場推廣資料;

• 不時就此列明的用途，核對任何與閣下有關的資料;

• 為遵守任何對我們具有約束力的法律或在合理期望下我們應遵守的任何監管或其他機構的指引或實務守則;

• 任何閣下同意及/或被通知之其他用途。

倘若閣下為18歲以下，向我們提供任何個人資料前，閣下必須先徵求閣下之家長或監護人之同意。

3. Disclosure 資料的披露

We shall take all practicable steps to keep your personal data confidential but for any one or more purpose(s) named in paragraph 2 above, we may transfer/assign your personal data to or exchange such data with any of the following parties irrespective of whether such parties are located inside or outside Hong Kong:

• any agent, contractor or third party service provider who provides administrative, telecommunications, computer and other services to us with respect to the operation of our business;

• our business partners assisting us in providing our products/services; or

• any person to whom we are under an obligation to make disclosure under the requirement of any law binding on us or for the purposes of any guidelines or codes of practice issued by regulatory or other authorities with which we are reasonably expected to comply.

Unless expressly stated in this statement or with prior consent, personal data collected from you will not be disclosed to any third party other than the above-named parties.

我們將採取所有切實可行的措施，將閣下的個人資料保密，然而為了任何上文第2段所列的單一或多個用途，不論以下人士位處香港境內與否，我們可向以下人士轉移/分派或與其交換閣下的個人資料：

• 向我們提供有關業務營運的行政、電訊、電腦及其他服務的任何代理人、承辦商、或第三者服務供應商;

• 協助我們提供產品/服務的業務夥伴；或

• 按對我們有約束力的任何法律要求或為了符合由監管或其他機構發出而我們應合理遵守的任何指引或工作守則而我們有責任向其披露資料的任何人士。

除本聲明明文表明或有事先同意外，向閣下收集的個人資料將不會向上列人士以外的任何第三者披露。

4. Use and provision of personal data in direct marketing 使用及提供個人資料作直接促銷

We intend to:

• use the Personal Data held by us from time to time for direct marketing of events, promotions and/or any other similar activities to be held at HART Haus and other collaborating sites;

• conduct direct marketing in relation to the following classes of products and services that we may offer: any new and/or existing services, products, facilities, activities, contests, lucky draws and/or other events, such as using our websites or mobile applications, following or using our social media accounts e.g. Instagram Official Account, receiving emails or text messages from us or sending us emails or text messages, using our telephone customer service, etc. relating to HART or our portfolios of properties similar to HART Haus and other collaborating sites or tenants in such portfolios of properties similar to HART Haus and other collaborating sites. If you do not provide the relevant Personal Data, you may not be able to register as our user, enjoy our services, or, even if we continue to provide you with certain services, the quality of such services may not be optimal;

• the above products and services may be provided by us and/or our business partners, agents and/or contractors.

In addition to marketing the above products and services, we also intend to provide the Personal Data to all or any of the persons described in sub-paragraph (iii) above for use by them in marketing those products and services, and we require your written consent (which includes an indication of no objection) for that purpose;

Before using your personal data for the purposes and providing to the transferees set out above, we must obtain your written consent, and we may use and provide your personal data for any promotional or marketing purposes only after having obtained such written consent.

You may in future withdraw your consent to the use and provision of your personal data for direct marketing.

If you wish to withdraw your consent, please inform us in writing to the address in the paragraph 10 below. We shall, without charge to you, ensure that you are not included in future direct marketing activities.

我們有意：

(i) 不時使用我們得到的個人資料作將於 HART Haus 及其合作據點舉行的活動、推廣及／或任何其他類似的事項的直接促銷用途;

(ii) 就我們可能提供的以下類別的產品及服務進行直接促銷用途:任何全新及／或現有服務、產品、設施、活動、比賽、幸運抽獎及／或其他事項，例如使用我們的網站或流動應用程式、關注或使用我們的社交媒體賬號（如Instagram官方賬號）、收取我們發送的或向我們發送電子郵件或短訊、使用我們的電話客戶服務等，以上可能有關我們或我們類似 HART Haus 及其合作據點的租戶的物業組合。若閣下不提供相關個人資料，閣下可能無法登記成為我們的使用者及使用有關服務，或即使我們繼續向閣下提供某些有關服務，我們有可能無法提供最佳品質的服務;

(iii) 以上產品及服務可能由我們及/或我們的業務夥伴、代理人及/或承辦商提供;

(iv) 除了促銷以上產品及服務，我們有意提供個人資料予以上第(iii)段描述所有或任何人士，以促銷該產品及服務，而我們需要閣下書面同意(可包括表明不反對)作此用途;

我們使用閣下的個人資料作以上用途，及提供閣下的個人資料予上述人士，必須得到閣下書面同意，及在得到該書面同意後，我們可使用及提供閣下的個人資料作宣傳或市場推廣用途。

閣下可於將來撤回就使用及提供閣下個人資料作直接促銷給予我們的同意。

如閣下希望撤回上述的同意，請以書面通知我們(見第10段的地址)。我們會確保閣下不會被加入未來直接促銷活動，亦不會向閣下收費。

5. Links to Other Websites 與其他網頁的連結

This Statement only applies to the Data Collection Means. In respect of our website(s) used as part of Data Collection Means, if you click on any advertisement or hyperlink linking to other website(s), you will leave this our website(s) for another location. At any other website, the protection of your privacy, personal data and your exposure to cookies are not our responsibility and you are advised to refer to the privacy policy of that other location (if any).

本聲明只適用於收集資料的渠道。有關我們收集資料的渠道的網站，倘若閣下按任何廣告或連結其他網站的超連結，即會離開我們的網站而進入另一個位置。在瀏覽任何其他網站時，我們並不負責保護閣下的私隱、個人資料及可能受到的“曲奇”之影響，我們建議閣下應自行參閱該位置的私隱政策（如有）。

6. Web Logs 網絡紀錄

When a user visits the home page of our website(s), the visit will be counted and included in the total number of visits to our website(s) for statistical purpose. This information does not identify you as an individual. No personal data will be collected.

7. Security 保安

Except as mentioned in paragraph 3 above, your personal data, however stored, will be accessed only by our employees or contractors who are authorized to do so and owe a duty of confidentiality to us. Such authorized personnel or contractors designated to handle personal data will be instructed to do so only in accordance with this Statement.

8. Use of Personal Data in Legal Proceedings 法律程序中個人資料的使用

If it becomes necessary that we have to take action against you for any reason whatsoever including but not limited to recovering from you any money you owe us, you expressly agree that the personal data provided by you can be relied upon in identifying and taking legal action against you.

閣下明確同意我們可基於任何原因，包括但不限於因追討閣下拖欠的款項而須向閣下採取行動時，根據閣下所提供的個人資料識別閣下的身份並向閣下採取法律行動。

9. Your Right to Access and Retention 閣下就個人資料的查閱及保存的權利

You may at any time request access to and correct personal data relating to you in any of our records. To exercise any of your rights, please contact us at the address below marking your communication “Confidential”. In response, we may ask you to provide certain details about yourself so that we can be sure you are the person to whom the data refers. We are required to respond to your requests within 30 days and we will endeavor to do so wherever possible, but we may charge you a reasonable fee for doing so.

閣下可隨時要求查閱及更正我們紀錄中與閣下有關的個人資料。倘若閣下須行使任何應有權利時，可按以下地址聯絡我們，並在通訊中註明「保密」字樣。我們在回應閣下的要求時，可能要求閣下提供某些有關閣下的詳細資料，以確認閣下是有關資料所指的人士。在閣下提出要求後，我們須要並將在切實可行的情況下盡力於30天內給予回覆，但我們可能因此需向閣下收取合理費用。

11. Retention of Data 資料的保留

We will only keep your personal data for as long as necessary to fulfill the purpose for which the data was collected unless the personal data is also retained to satisfy any applicable statutory or contractual obligations. Personal data which no longer required will be destroyed.

除按適用的法例或合約的責任而須保留的個人資料外，我們只會在需要履行收集資料的目的之期間內保留閣下之個人資料。無需保留的個人資料將會被銷毀。
